Terms of Service

These terms govern your use of Lokkate, a GPS vehicle tracking and remote vehicle control service operated by Lokkate Technologies in Accra, Ghana. By creating an account, signing in, or using a Lokkate tracker, you agree to them.

1. The service

Lokkate consists of tracking hardware installed in your vehicle, and software that shows you where the vehicle is, where it has been, and its status. Some plans also let an authorised user immobilise the vehicle remotely.

Features and pricing may change. Where a change reduces what you already pay for, we will tell you before it takes effect.

2. Your account

You must be 18 or older and provide accurate details. You are responsible for keeping your password secure and for everything done under your account. Tell us immediately if you think someone else has access to it.

Account owners can invite other people and set what each of them can see and do. If you invite someone, you are responsible for their use of the account.

3. Fees and payment

Charges are quoted in Ghana cedis and itemised: the tracking device, its installation, the SIM, and a recurring per-vehicle tracker service covering airtime and monitoring. Onboarding charges are payable before tracking is activated. Tracker service charges are billed on a recurring basis and are due by the date shown on the invoice.

If an invoice goes past its due date we may suspend tracking for the affected vehicles until the balance is settled. Suspension does not cancel the outstanding amount. Charges already paid are not refundable except where the law requires it or where we have failed to deliver the service.

4. Hardware and installation

Tracking hardware supplied by Lokkate must be installed by us or by an installer we approve. Devices remain covered by their manufacturer warranty against defects. The warranty does not cover damage from accident, misuse, tampering, or unauthorised removal or reinstallation.

You agree not to disconnect, obstruct, or tamper with the device, and to give us reasonable access to the vehicle to service or recover it.

5. Remote immobilisation

This feature can stop a vehicle from starting. It is serious, so:

  • Only use it on a vehicle you own or are lawfully entitled to immobilise.
  • Only issue the command when the vehicle is stationary and safe. The app will refuse the command above a low speed threshold, but that check is a safeguard, not a guarantee.
  • A command is delivered over a mobile network to hardware in a vehicle. It may be delayed or fail if the vehicle has no signal, no power, or is out of coverage.
  • You are responsible for the consequences of a command you issue. Do not use it to strand, endanger, or coerce anyone.

We may refuse or reverse an immobilisation where we believe it puts someone at risk or is being used unlawfully.

6. Acceptable use

You agree not to:

  • Track a person or vehicle you have no lawful right to track.
  • Fit a tracker to a vehicle driven by someone else without informing them that it is tracked.
  • Use the service to harass, stalk, or intimidate anyone.
  • Resell, sublicense, or rebrand the service without our written agreement.
  • Attempt to breach, probe, or overload our systems, or access data belonging to another customer.

We may suspend or terminate an account that breaches this section, without refund.

7. What we do not promise

Lokkate depends on GPS satellites, mobile networks, and third-party infrastructure that we do not control. We do not guarantee that location data will always be available, accurate, or timely, that alerts will always be delivered, or that the service will prevent or recover a theft.

The service is a tool to help you protect and manage your vehicles. It is not a security guard, an insurance policy, or a substitute for either. Do not rely on it as your only protection.

8. Limitation of liability

To the fullest extent the law allows, Lokkate is not liable for loss of a vehicle, loss of profit, loss of business, or any indirect or consequential loss arising from your use of the service or from its unavailability. Our total liability to you for any claim is limited to the fees you paid us in the twelve months before the claim arose.

Nothing here excludes liability that cannot lawfully be excluded.

9. Privacy

Our Privacy Policy explains what we collect and why, and forms part of these terms. If you track drivers or rental customers, section 4 of that policy sets out your obligations to them.

10. Ending the agreement

You can delete your account from Settings at any time. Deleting it removes your login and your personal data.

If yours is the only account on the profile, deleting it also ends the service: tracking stops and monthly billing is cancelled. If other people are still on the account, it keeps running for them and your deletion changes nothing else.

Either way, deleting your account does not clear an unpaid balance or take the hardware out of the vehicle. Contact us to settle a balance and arrange device removal.

We may suspend or end the service for non-payment, for a breach of these terms, or if we are required to. Where we end it without cause we will refund any prepaid period not yet used.

11. Governing law

These terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have jurisdiction over any dispute arising from them.
